Terms of Service
Effective March 5, 2026
1. Agreement
These Terms of Service ("Terms") govern your use of the SixtyOps software, website (sixtyops.net), and related services (collectively, the "Service") provided by Isaac Olson, doing business as SixtyOps ("we", "us", "our"). By downloading, installing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
2. Service Description
SixtyOps is a self-hosted network management appliance that automates firmware updates, configuration backups, and maintenance scheduling for Tachyon wireless network devices. The Service runs on your infrastructure as a virtual appliance.
3. License Grant
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to install and use the SixtyOps appliance for your internal business operations. This license is for a single appliance instance per organization unless otherwise agreed in writing.
4. Subscriptions & Pricing
SixtyOps offers the following tiers:
- Free: Manage up to 4 access points. Includes auto-updates, maintenance windows, and monitoring.
- Pro: $1/month per access point + $1/month per switch. Subscriber modules (CPEs) are always free.
Pro subscriptions are billed monthly and auto-renew unless cancelled. You may cancel at any time; cancellation takes effect at the end of the current billing period. No refunds are issued for partial billing periods.
We reserve the right to change pricing with 30 days' advance notice. Price changes do not apply retroactively to the current billing period.
5. Restrictions
You agree not to:
- Reverse engineer, decompile, or disassemble the Service
- Resell, sublicense, or redistribute the Service to third parties
- Circumvent license validation, device limits, or feature restrictions
- Use the Service to distribute malicious firmware or code
- Interfere with the operation of the license server or telemetry endpoints
- Remove or alter any proprietary notices or labels
6. Your Responsibilities
You are responsible for:
- Maintaining compatible Tachyon network devices and adequate internet connectivity
- Securing your appliance, including administrator credentials and network access
- Ensuring firmware updates are appropriate for your network before deploying at scale
- Backing up your appliance and device configurations
- Complying with all applicable laws in your jurisdiction
7. Software Updates
The SixtyOps appliance checks for software updates via GitHub Releases. Updates may be applied automatically or manually at your discretion, depending on your appliance configuration. We recommend keeping your appliance up to date, but you are not required to install any specific update.
8. Data Ownership
You retain full ownership of all data stored on your SixtyOps appliance, including device information, configurations, credentials, and operational logs. We do not access, collect, or claim any rights to your appliance data. See our Privacy Policy for details on the limited data we do receive.
9. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
Without limiting the foregoing, we do not warrant that:
- The Service will be uninterrupted, error-free, or secure
- Firmware updates will not cause device issues or network downtime
- The Service will be compatible with all device firmware versions or hardware revisions
- Data stored on your appliance will not be lost or corrupted
Firmware updates carry inherent risk. You are responsible for testing updates in your environment and maintaining rollback capabilities.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, BUSINESS INTERRUPTION, NETWORK DOWNTIME, OR DEVICE DAMAGE, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.
OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE TOTAL FEES YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.
11. Indemnification
You agree to indemnify, defend, and hold harmless SixtyOps and its owner from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your negligence or misconduct.
12. Termination
Either party may terminate this agreement at any time. You may stop using the Service and uninstall the appliance. We may suspend or terminate your access if you violate these Terms, with 30 days' written notice to cure the violation where practicable.
Upon termination, your license to use the Service ends. All data on your appliance remains yours — we do not have the ability to delete it. Pro features will revert to Free tier functionality if your license expires or is not renewed.
13. Governing Law
These Terms are governed by the laws of the State of Minnesota, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved in the state or federal courts located in Minnesota, and you consent to the personal jurisdiction of such courts.
14. Changes to These Terms
We may update these Terms from time to time. Changes will be posted on this page with an updated effective date. Your continued use of the Service after changes are posted constitutes acceptance of the revised Terms. For material changes, we will make reasonable efforts to provide advance notice.
15. Miscellaneous
- If any provision of these Terms is found unenforceable, the remaining provisions remain in effect.
- Our failure to enforce any provision does not waive our right to enforce it later.
- You may not assign these Terms without our prior written consent. We may assign our rights and obligations without restriction.
- These Terms constitute the entire agreement between you and SixtyOps regarding the Service.
